1 Terms and Conditions:

  1. Guarantee applies only to 1st lien position purchase or refinance transactions closed and funded by Capital Bank. Eligible loans are Secondary Mortgage Market loans sold in accordance with Fannie Mae and Freddie Mac and Capital Bank Portfolio loans.
  2. Government Guaranty loans (VA, USDA, State Bond Programs), loans requiring Private Mortgage Insurance (PMI), and Capital Bank Construction and Home Equity Lines of Credit are not eligible.
  3. To be eligible, the closing date identified hereinabove (“Closing Date”) shall not be less than 30 days from Capital Bank’s receipt of your completed application.
  4. All of the following constitutes a completed application:
    1. Completed and signed application form;
    2. All information requested on the Residential Mortgage Loan Request Documentation Checklist;
    3. Signed initial disclosures, including your intent to Proceed;
    4. Payment for your appraisal report;
    5. Signed copy of purchase and sale agreement which includes a closing date, including lender signature and acknowledgement if transaction is a short sale or foreclosure; and
    6. Any additional required information as requested on the Welcome Letter or Notice of Incomplete in the time frame indicated but no less than seven (7) business days prior to the Closing Date.
  5. "Guaranteed closing date" is not a mortgage loan approval guarantee or a commitment to lend and is subject to customer satisfying all underwriting guidelines and loan approval conditions and obtaining an acceptable property appraisal and title report.
  6. Capital Bank reserves the right to amend or terminate this Guarantee at any time, without notice. (Eligible purchase transactions under this Certificate that have closed prior to amendments or termination will remain eligible.)
  7. In the unlikely event Capital Bank causes a delayed closing and does not contribute payment toward your closing costs under the terms of this Certificate, applicant must notify Capital Bank within 90 days of the Closing Date. Whether applicant is due a contribution or not, applicant is responsible for making all mortgage payments per loan closing documents.
